PROPHETIC Healing and Deliverance Ministries leader, Walter Magaya, was back at the Harare Magistrates Court this Thursday to argue for his rape case to be referred to the Constitutional Court.
Magaya is seeking a constitutional referral in a case in which he is accused of raping three complainants, with the allegations dating back to 2013.
This Thursday, Magaya took to the witness stand to justify his decision to seek his case to be referred to the Constitutional Court.
Magaya made claims that the prosecution tampered with the witness statements, and he was forced to do DNA tests at a local hospital.
He argued that the alleged actions of the State were unconstitutional, hence his fight to have the matter referred to the Constitutional Court.
The State is, however, opposed to Magaya’s claims and request for Constitutional Court referral of his matter, arguing that the cleric is making inconsistent demands.
According to the state, Magaya is demanding the DNA results in question, while also seeking the nullification of the same results at the High Court.
The case will be heard this Friday again, where the PHD Ministries leader is expected to continue with his submissions.
Apart from this case, which is before the courts, Magaya also stands accused of raping four other women, and he is also seeking the matter to be heard at the Constitutional Court, claiming Constitutional breaches
